I know a guy who cheats on his wife. He cheats on her every day. He cheats on her multiple times a day. He’s a husband and a father and a serial adulterer.

I shouldn't know this fact about him, but it came up in conversation a few days ago. We were talking about the divorce rate; both of us gave our theories as to why the statistics are so high. I mentioned in my diagnosis a few studies that show pornography to be a root cause in over 50 percent of divorces annually.

He laughed. “People don’t get divorced over porn.” He went on to explain that porn isn't a “big deal” to most people. It’s not “like it’s cheating or something.” He told me that he looks at it multiple times daily. His wife, he insisted, might be a little peeved if she knew the extent of it, but only because women overreact about “that kind of thing.”

What kind of thing? Their husbands spending all day obsessively plunging through the darkest regions of the internet for graphic sexual images of rape, abuse, perversion, exploitation and other forms of filthy depravity previously unknown to mankind?

Yeah. That kind of thing. No reason why any wife should be too upset about that, apparently.

Listen guys, I know this is an uncomfortable conversation. But it’s time we man up and get real about pornography. First things first: if you’re married and you look at porn, you are cheating. Period. From a Christian perspective, this can’t be debated. Christ laid it out very clearly: if you lust after another woman, you have committed adultery. When we look at porn we are choosing to succumb to that lust; we are indulging it, fertilizing it, giving it respite in our minds. We are diving into it headfirst and soaking in it like a sponge. We are lessening ourselves, betraying our wives and girlfriends and participating in the violent exploitation of women (and girls). Or minds and our bodies belong to the Lord and to our wives; pornography, therefore, intrudes on their domain. If we look at porn, we are adulterers. We are adulterers in all the worst ways.

We don’t even need to refer to Scripture to figure out the simple equation that porn equals adultery.

Why wouldn't it?

Because you aren't physically in contact with another woman?

So what? That’s merely a matter of semantics and circumstance. The absence of physical touch doesn’t automatically free you of the scarlet letter — if it did, ‘sexting’ with other women would be fair game, I suppose. How would you feel if you looked through your wife’s phone and found racy, sexually graphic text messages she’d sent to a man at her office? Would you be alright with it as long as she could prove she never had any physical contact with him? Or is that totally different because she knows the guy, whereas porn is anonymous and impersonal? See, we find ourselves constructing many arbitrary lines of distinction when we are determined to rationalize behavior we instinctively know to be immoral and wrong.

But, OK, what if she didn’t know the guy? What if she was engaging in “fantasies” with men she never met? Imagine that, in your cyber travels, you stumbled upon a porn site featuring pictures and videos of a particularly alluring young female: your wife. How would that sit with you? Your wife selling digital sex all over the internet — how would you like that? It might cause a bit of a marital dispute, wouldn't you say?
If you wouldn't want your wife being a porn provider, you ought to understand why she wouldn't want you to be a porn consumer. If you wouldn't want her to invite and encourage other men to violate her in their minds, you ought to understand why she wouldn't want you to accept the invitation to violate other women in yours.

I don’t mean to concentrate only on married men. Porn is poison for everyone, married or not. And I’m not here to castigate you if you've stumbled. We live in a society that preys upon a man’s weaknesses, shoving sex into his face at hyper speed every day, all day, all of the time. This is not excuse; just an attempt to put things into context. I won’t yell at a guy who fights a porn addiction anymore than I’d yell at a guy who fights a crack addiction. But at least the crack addict likely won’t encounter very many people (besides his dealer) who will tell him that it’s actually healthy to smoke crack. If he ventures outside of the abandoned shack where he scores his dope, he probably won’t find any respectable people who will say, “hey, crack is not a big deal — it’s totally natural to smoke crack, man!” In that way, the crack smoker has a leg up on the porn addict. The porn addict, by contrast, has to fight both the compulsion itself and the myriad of creeps who will try to convince him that it’s all just a bit of innocent fun.
That’s a lie, of course. It’s not innocent. It’s not fun.

I could cite for you the mounds of psychiatric research proving the detrimental effects of pornography on the brain. But you can do that research yourself.

I could tell you about sex slavery, human trafficking, drug abuse, and child molestation, and I could explain how the porn industry wouldn't exist without these necessary ingredients. I dove into this subject because I wanted to learn more; yo understand what went wrong in my life 20 years ago.

But these are conclusions you can draw on your own, if ever you take even a moment to think about it.

I could remind you that these women you find on your porn sites might not be women at all — they could be children — and there’s no way for you to know for sure. I could then point out that any avid porn customer has most likely at some point been a child porn customer, whether he knew it or not. But this is, indeed, an obvious and inescapable reality. And this is shocking but true.

I could tell you that many children view graphic porn for the first time before the age of 12. I could tell you that we haven’t even begun to reap the atrocious fruits that will come from an entire generation raised on the heinous perversions of internet pornography. But it’s probably too late for these warnings.

So what is left? Perhaps nothing, really. Pornography is evil, empty, deadening, dirty — this is something we all know. That’s why, unless you are either psychotic or utterly despicable, you wouldn’t want your daughter to get into the porn business. That’s why most people hide their porn habits. That’s why it still isn’t considered acceptable to browse “adult” websites at your desk at work or at a table in Starbucks (although people still do, in both scenarios). That’s why you only find porn shops and strip clubs in the slummy, rundown parts of town. No matter how hedonistic and “open minded” we become, we still recognize porn as something that ought to be stowed away in the dank, dark corners of our lives. This is Natural Law, and we can’t escape it. We have an innate understanding of right and wrong, whether we want it or not.

Married men: I think we should be spending our free time with our families, or reading interesting books so that we can sharpen our minds, or building things, or exercising, or doing anything else that will make us better men. Porn will not make you a better man. It will make you smaller. It will make you a liar. It will kill that instinct inside you that calls you to protect and honor women. It will turn you into something you never wanted to be. It will turn you into a sneaky, shameful pervert. Guys in relationships... it is the same for you

The bottom line is that I crossed the line and no matter how naive or stupid I was "as a kid" , I was held accountable. Do the right thing and do your own research and if not for yourself, do it for the ones you love. And no matter what, if you are in this position, read the links below and get in touch ASAP!

Many people think that child pornography cases involving the distribution, receipt, or possession of child pornography are not that serious because these offenses do not involve an actual victim. Whereas the production of child pornography usually involves the use of actual children, the possession and distribution of child pornography do not. Most people don't realize the serious ramifications of these “sex crimes.” Even looking at or possessing on your computer or other electronic device a few photographs is a very serious crime that can carry a minimum of five years in prison in the case of a Federal Child Pornography case.

The federal code section for this offense is 18 U.S.C. 2252.

These cases are very serious even in state court today. Many counties in the state of California, for instance San Francisco and Alameda Counties, used to routinely charge these crimes as misdemeanors that carried very little jail time, if any. While a violation of California Penal Code section 311.11 (Possession of Child Pornography) and related charges were clearly viewed as less serious, they did (and do) still carry lifetime Sex Offender Registration pursuant to California Penal Code section 290. Thus, it is essential that when someone is informed that there is an active investigation into the possession of child pornography, distribution of child pornography or any other related offense, they immediately obtain the services of an experienced and skilled criminal defense attorney who specializes in dealing with Possession of Child Pornography and Distribution of Child Pornography cases.

If you have been informed of such an investigation or that Child Pornography charges have been filed, we recommend that you call us immediately

INCREASE IN CASES

The department of justice reports a 2,500 percent increase in child pornography-related arrests over the last 10 years. While there are many factors that draw everyday people to child pornography, the technological advances of the internet and the proliferation of Peer to Peer (P2P) networks have made it very easy to obtain and share or distribute child pornography, sometimes without even knowing it is happening. Anyone with a computer connected to the internet can obtain an unlimited amount of illegal images or videos with the click of a mouse.

The federal government in particular, not to mention various State of California Task Forces, are stepping up their investigations by actively conducting sting operations, pro-actively posing on or infiltrating internet chat rooms, tracking IP addresses and investigating file sharing networks. We have seen a huge proliferation of child pornography cases in Federal Court and throughout California and the United States. Along with this, the Federal Courts have imposed a significant increase in the length of prison sentences for federal defendants convicted of these types of sex offenses.

HOW INVESTIGATIONS ARE CONDUCTED

A typical child pornography investigation within a file sharing network involves the Police or FBI signing on to a P2P network, either under a fake username or by using an existing user's credentials. Once on the network, the police will browse the network and search for incriminating files.

When a P2P user downloads a file, the program places it into a “shared” folder. In addition, the user can add additional files from his or her personal collection into this shared folder so that others may gain access. Some P2P programs allow users to configure their shared folders in order to restrict what files to share and with whom. However, the FBI has developed a program called “EP2P” which allows it to see all of a user's shared files, and may even have the ability to change the shared file's settings. Suffice it to say that the government has very sophisticated methods of identifying and locating child pornography despite any precautions an individual may take.

When the FBI has identified suspected child pornography inside another user's shared folder, it will use another program to identify and track that user's IP address. All IP addresses are correlated with a physical location through an Internet Service Provider (ISP), for example AT&T. Once the IP address is obtained, they will subpoena the ISP for the owner's personal information and physical location of that IP address and obtain a search warrant to search that location. The search warrant will often include a command to search for any computer equipment, electronic media, personal papers and documents, indicia establishing that the person lives at or has access to that premises and of course any evidence of illegal material such as photos, videos, magazines or other hard copy of child pornography.

WHAT SHOULD I DO IF I AM UNDER INVESTIGATION OR HAVE BEEN ARRESTED?

1. Assert your rights.

If the FBI or police come to your door, there are two phrases you should repeat over and over: “I want an attorney” and “you do not have permission to search.” It is very important to remain silent except for the two phrases above. Do not engage in small talk or try to explain anything away. Undoubtedly, the FBI or police will try to get you to change your mind and speak with them. The Supreme Court has said that under certain circumstances investigators may even lie to you to induce you to admit you committed a crime. You must resist their tactics, whether you are innocent or guilty. If the FBI or police have a warrant, do not obstruct them but then again never consent to anything either. Remember that they are there for the sole purpose of making their case and establishing your guilt, so anything you do or say will be used against you. Their goal is to build a case and to see that you are convicted and put in prison.

If the FBI is not at your door or you have not yet been arrested, but you have reason to believe you are under investigation, you should still immediately obtain legal representation from an experienced and skilled lawyer who specializes in Possession and Distribution of Child Pornography cases. Your attorney can evaluate your case and then recommend your best course of action, whether you should cooperate with the government, to what degree, and in many cases help you avoid criminal charges before they are filed.

2. Deleting files.

Many people believe that hitting the delete button on their computer makes a file disappear forever. Some might therefore think that viewing child pornography and immediately deleting those files, internet histories, logs, and cookies will cover up any evidence of wrong-doing. In fact, deleting a file only sends it to another part of a computer's hard drive where it is stored indefinitely until it is over-written by another file. The government possesses very sophisticated computer forensic software that can recover files long after they have been deleted.

3. Get the help you need from an experienced and highly skilled lawyer.

Whether you are completely innocent or have actually viewed, possessed, distributed or even produced child pornography, it is essential that you retain the services of a highly experienced and skilled lawyer who specializes in the area of possession and distribution of child pornography or related charges. Furthermore, you must fully apprise your attorney of all relevant information related to your case so that he can fully defend you. The FBI and other federal agencies, the police, and prosecutors carry inherent biases with them. A good lawyer will investigate your case and find gaps in the evidence or mistakes in the investigation. This attorney will raise these issues with the prosecutor in an effort to get the case or certain charges dismissed or to mitigate any potential punishment.

4. Help Yourself.

There are several things you can do to help your own case. These often include submitting to a polygraph examination, collecting work and personal letters of reference and recommendation, cooperating with your attorney and assisting the attorney in the investigation of your case, submitting to a psychological evaluation or sex-offender evaluation, participating in treatment including participation in a 12-Step program for sexual addiction, sexual compulsion or Obsessive Compulsive Disorder (OCD) and cooperate with the attorney in any effort to obtain a forensic examination of your computer hard drive (which should be done in virtually every case). There are many potential defenses that can arise from the forensic examination of the computer, but it takes a highly skilled and savvy attorney to make sure this procedure is thorough and precise.

If you are in this situation or need help with a case like this, you should call us immediately

To recap, you should do the following:

Don't talk to the law enforcement investigator other than to deny the allegations. Tell the investigator, ” I am requesting to speak to a lawyer” and deny any request to conduct a search of any person, place or thing;

Immediately contact and retain the services of a highly experienced and skilled attorney, whether an investigation is anticipated, has just begun or charges have already been filed;

Seek professional help, including psychological counseling or participation in a 12-Step program, where needed or appropriate.

When someone is caught, charged and prosecuted as a sex offender, they lose a great many rights they once had. Depending on the state, they have to register themselves as an offender, alert their neighbors and even keep a safe distance from any public place where children congregate. It’s likely a majority of Americans feel that these restrictions are warranted and even wise, but now some sex offenders are fighting against rulings that ban them from using social networking sites, such as Facebook.
Claiming free speech rights, these sex offenders are challenging the rulings that prevent them from using certain sites and services on the internet: Sites and services which could allow them an avenue to commit the same crimes all over again.
For their part, Facebook and LinkedIn have gone on record by altering their policies to show their support of these kinds of bans against sex offenders.
According to the Chicago Tribune, several sex offenders in Indiana, Nebraska and Louisiana have been able to successfully challenge these rulings, arguing that the use of social networking and other online discussions is a part of their human rights to free speech. Many authorities are in support of the bans, saying they are necessary to keep children safe from these predators when they are online. Often, these children can be online without their parent’s knowledge, making the restrictions all the more important.
In Indiana, the American Civil Liberties Union (ACLU) is heading the fight on behalf of a man who has served a 3 year sentence for child exploitation, as well as other registered sex offenders who are out on probation but are still affected by the ban.
Thursday, Judge Tanya Walton Pratt of the Indianapolis U.S. District Court questioned attorneys about sex criminals’ rights, and whether denying them access to Facebook and other sites like it infringe on their free speech.
Attorney for the ACLU Ken Falk argued the 4-year old law was meant to protect children, but instead it is stopping these registered sex criminals from expressing their political and religious views on websites which allow you to leave comments via your Facebook login.
According to the Associated Press, Falk believes this law violates the rights of communication, which the U.S. Supreme Court has ruled is guaranteed by the First Amendment. Falk also argued that the ban is unnecessary in the state of Indiana, saying there is already another law which makes using the internet to contact a child for sexual purposes a crime.
Indiana Deputy Attorney General David Arthur argued that the 2008 ban is limited to social networking sites, and therefore doesn’t stop a sexual criminal from communicating with a child in some other way.
“We still have television. We still have radios. And believe it or not, people still talk face-to-face,” he said. Arthur also said the ban doesn’t extend to email or message boards.
“It’s not enough to say that the plaintiffs can still write letters or go to meetings,” Falk said, claiming it’s unfair to insist the criminals not be allowed the privilege of online communication.
“These are not adequate alternatives for instant communication.”Robert Paisolahttp://www.blogger.com/profile/00435871035547197331noreply@blogger.com0tag:blogger.com,1999:blog-1912588256876634544.post-89663770576237346662011-06-02T14:29:00.000-07:002011-06-02T14:29:44.893-07:00Federal Sencing Commission Garners Reversal of Crack Cocaine Federal Sentencing Desparity, Robert Paisola ReportsYesterday, the U.S. Sentencing Commission held its hearing on whether and how to make the new crack guideline retroactive. It was a jam-packed and exciting day. Here is my quick recap:

Dozens of FAMM members attended the hearing, traveling from as far away as Indiana, Michigan, New Hampshire and North Carolina. FAMM's president, Julie Stewart, told the commissioners, that the mere presence of so many family members was more powerful than anything the witnesses could possibly say.

But happily, witness after witness called for retroactivity, starting with the U.S. Attorney General, Eric Holder. While he also called for restrictions on who might benefit, we hope that the Commission will listen to the many, many others who testified that retroactivity should be available for everyone, not just some. Judging from the tough questions Commissioners asked the Department of Justice witness who testified with the Attorney General, we are cautiously optimistic that they will listen more to the Department's support for retroactivity and less to the Department's call for restrictions on who should be eligible for retroactivity.

You can read Julie's written statement here and to FAMM member Natasha Darrington's excellent testimony here. Natasha did an amazing job delivering her testimony, bringing some of the commissioners and audience to tears. And when Julie asked the FAMM members with loved ones in prison to stand and be recognized, it was clear the commissioners were visibly moved. FAMM plays a powerful role in reminding policy makers who their policies impact. (Expect an email from us soon with video and pictures from the hearing.)

Media coverage of the hearing was limited but excellent. The New York Times interviewed Julie in a piece that appears here. National Public Radio (NPR) interviewed Julie and Natasha for a segment that aired this morning on Morning Edition found here. Natasha appeared on another NPR show, Tell Me More, found here. FAMM was also quoted in an Associated Press print story and radio clip in advance of the hearing.

Finally, I want you to know that even those of you who couldn't attend the hearing had an impact. The Commission mentioned that it had received over 34,000 letters in support of retroactivity. THANK YOU for taking the time to make your voices heard by sending in letters and signing our petition!

So, what's next? The Commission will hold a vote on retroactivity sometime this summer. We will be back in touch to let you know what we're doing to make sure the vote comes out right.

It was an exciting day and your support helped make it so. Thank you so much!

Sincerely,

Jennifer
Our group has swelled to over 130,000 members. Thank you all for sending out invitations and being members of this group. I know that I always say this, but you stand as a voice for the unspoken majority in this country that believes in our traditional Christian values that built this country. With that in mind I wanted to share some thoughts on the meaning of the holiday we will be celebrating this weekend.

On July 4th, America's independence will be celebrated in grand fashion with parades, fireworks and backyard BBQs. Did you know that this year (2010), Americans will commemorate the 234th anniversary of the approval of the Declaration of Independence by the Continental Congress, the act that set the 13 American colonies on their road to national sovereignty?

Take a moment to watch this video that we have produced in association with our friends at The Free Capitalist Project and Founders University. This is an amazing historical image of what it takes to truly be free as Americans.

When enjoying this weekend’s festivities, have fun and be safe, but take a moment to remind yourself and your family what this day represents. This day stands in history as the day a group of our countries forefathers declared their freedom; freedom from tyranny, religious persecution and taxation without representation. Since the enactment of the SRA, Congress has repeatedly created new offenses, increased penalties, and issued directives to the Commission concerning child pornography offenses. 3/ The following is a list of many of the laws enacted by Congress over the last three decades regarding child pornography-related offenses:

•Protection of Children Against Exploitation Act of 1978;
•Child Protection Act of 1984;
•Child Sexual Abuse and Pornography Act of 1986;
•Child Abuse Victims’ Rights Act of 1986;
•Child Protection Restoration and Penalties Enhancement Act of 1990;
•Sex Crimes Against Children Prevention Act of 1995;
•Protection of Children from Sexual Predators Act of 1998;
•Prosecutorial Remedies and Other Tools to end the Exploitation of Children Today Act of 2003;
•PROTECT Our Children Act of 2008;
•Providing Resources, Officers, and Technology to Eradicate Cyber Threats to Our Children Act of 2008;
•Keep the Internet Devoid of Sexual Predators Act of 2008; and
•Effective Child Pornography Prosecution Act of 2008.

This endless stream of legislation has contributed to an increasing, and more open, judicial chaos in the specific area of child pornography sentencing. This chaos was highlighted in the case of Jeremy Goldberg who pled guilty in March 2006 in the United States District Court for the Northern District of Illinois to a single count of possession of child pornography. U.S. District Court Judge Joan B. Gottschal sentenced Goldberg to one day in prison, credit for time served, and ten years of supervised release. 4/ The Government appealed the sentence as unreasonably lenient, and in June 2007 the Seventh Circuit Court of Appeals agreed, remanding Goldberg’s case back to Judge Gottschal for resentencing. 5/ On remand, Judge Gottschal sentenced Goldberg to 48 months of imprisonment, recommended that he be placed in a Sex Offender Treatment Program operated by the Federal Bureau of Prisons, and imposed ten years of post-release supervision. 6/

But Judge Gottschal did not shy away from the Seventh Circuit’s remand order. She pointed out in her sentencing memorandum on remand that she had explained the original sentence as best she could, and added that a fair reading of her explanation was not “consistent with the Seventh Circuit’s assessment of it.” She noted that the appeals court not only quarreled with the way she had justified Goldberg’s original sentence but quarreled with the sentence itself. 7/ The judge cited the following portion of the Seventh Circuit’s ruling to support her position:

“A prison sentence of one day for a crime that Congress and the American public consider grave, in circumstances that enhance the gravity (we refer to the character of some of the images), committed by a convicted drug offender does not give due weight to the ‘nature and circumstances of the offense,’ ‘promote respect for the law,’ or ‘provide just punishment for the offense.’ It does not ‘afford adequate deterrence to criminal conduct.’ And it creates an unwarranted sentence disparity, since similarly situated defendants are punished with substantial prison sentences.” 8/

Perhaps it was the Seventh Circuit’s reference to “sentence disparity” that prompted Judge Gottschal to call out the appeals court. Over an 18-month period Jeremy Goldberg downloaded from the Internet hundreds of images of children—some as young as 2 or 3—engaged in sex acts with adults. He offered these images to other subscribers of a web site in an effort to procure similar images from these subscribers. And he would masturbate while viewing the child pornography. 9/ Judge Gottschal in some detail examined sentences imposes in what she called “comparable cases in its sister courts.” 10/ As noted by Judge Cottschal, the following cases illustrate the disparity in the way similar child pornography cases are charged and sentence:

•Kirkham v. United States, 2008 U.S. Dist. LEXIS 31046 (D. Utah 2008): child pornography case involving 5,129 images given a 120-month sentence where Guidelines recommended sentence range of 135-168 months.
•United States v. Sudyka, 2008 U.S. Dist. LEXIS 42569 (D. Neb. 2008): child pornography case involving 3000 images given a 24-month sentence where Guidelines recommended sentence range of 63-78 months.
•United States v. Baird, 2008 U.S. Dist. LEXIS 2338 (D. Neb. 2008): child pornography case involving 800 images given a 24-month sentence where Guidelines recommended sentence range of 46-57 months.
•United States v. McElheney, 524 F.Supp.2d 983 (E.D.Tenn. 2007): child pornography case involving 200 images given 135-month sentence where Guidelines recommended sentence range of 135-168 months.
•United States v. Thomas, 2008 U.S. Dist. LEXIS 15937 (N.D. Ill. 2008): child pornography case involving 200 images given 84-month sentence where Guidelines recommended sentence range of 168-210 months.
Judge Gottschall then pointed to the sentence disparities found among the federal circuits:

•United States v. Perez, 484 F.3d 735 (5th Cir. 2007): sentence of 57-months upheld in child pornography case involving thousands of images stored on 4000 compact discs.
•United States v. Kirchhof, 505 F.3d 409 (6th Cir. 2007): sentence of 180 months upheld in child pornography case involving 992 images where Guidelines recommended sentence range of 210-262 months.
•United States v. Grinbergs, 470 F.3d 758 (8th Cir. 2006): sentence of 12 months and a day reversed in child pornography case involving 348 images where Guidelines recommended sentence range of 46-47 months.
•United States v. Kerr, 472 F.3d 517 (8th Cir. 2006): sentence of 151 months upheld in child pornography case involving 45-50 images (some sadomasochistic).
•United States v. Meiners, 485 F.3d 1211 (9th Cir. 2007): sentence of 180 months (statutory mandatory minimum) upheld in child pornography case involving 10,000-12,000 images (some sadomasochistic).
•United States v. McBride, 511 F.3d 1293 (11th Cir. 2007): sentence of 84 months upheld in child pornography case involving 981 images where Guidelines recommended sentence range of 151-188 months.
Judge Gottschal did not stop with the sentencing disparities found in other federal circuits in child pornography cases. She pointed to blatant disparities in such cases found in the Seventh Circuit itself:

•United States v. Lowe, 516 F.3d 580 (7th Cir. 2008): sentence of 144 months upheld in child pornography case involving 6500 images.
•United States v. Shrake, 515 F.3d 743 (7th Cir. 2008): sentence of 330 months in child pornography case involving 600 images where Guidelines recommended a sentence range of 292-365 months.
•United States v. Baker, 445 F.3d 987 (7th Cir. 2006): sentence of 87 months upheld in child pornography case involving 300 images where Guidelines recommended sentence range of 108-135 months.
•United States v. Barevich, 445 F.3d 956 (7th Cir. 2006): sentence of 76 months upheld in child pornography case involving 8178 images where Guidelines recommended sentence range of 87 to 108 months.
•United States v. Wachowiak, 496 F.3d 744 (7th Cir. 2007): sentence of 70 months upheld in child pornography case involving more than 600 images (some sadomasochistic) where Guidelines recommended sentence range of 121-151 months.
These cases reflect there is no real rhyme or reason to the actual sentences imposed in child pornography cases or in the Guidelines that govern such sentences. This point was made clear by Judge Kathleen M. O’Malley in the case of Evan M. Stern who pled guilty to possession of child pornography in the United States District Court for the Northern District of Ohio. The Guidelines recommended a sentence range of 46 to 57 months. Judge O’Malley, who rarely ever deviates from the recommended Guidelines sentence range and who has a history of imposing harsh sentences in child pornography cases, imposed a sentence of 12 months and 1 day of incarceration on Stern. 11/ Citing the Jeremy Goldberg decision, Judge O’Malley made these observations about sentencing disparity in child pornography cases:

“This Court has carefully considered an extremely wide variety of opinions from across the country as well as the National Guidelines Statistics … The Court is deeply troubled by its findings: ‘anyone seriously concerned about federal sentencing disparities [must begin by] taking a very close look at federal child porn cases.’ Professor Douglas A. Berman, Is there an Ivy-Leaguer Exception to Federal Child Porn Charges? (October 22, 2008) … Based on the Court’s review of the case law, it is clear that ‘one would be hard pressed to find a consistent set of principles to explain exactly why some federal porn defendants face decades in federal prison, some face many years in federal prison, while others only end up facing months.’ Id. This Court is ‘struck by the inconsistency in the way apparently similar cases are charged and sentenced.’

“In short, the national sentencing landscape presents a picture of injustice. In the absence of coherent and defensible Guidelines, district courts are left without a meaningful baseline from which they can apply sentencing principles. The resulting vacuum has created a sentencing procedure that sometimes can appear to reflect the policy views of a given court rather than the application of a coherent set of principles to an individual situation. Individual criminal sentences are not the proper forum for an expansive dialogue about the principles of criminal justice. Such conversation, though vital, should not take place here—lives are altered each and every time a district court issues a sentence: this is not a theoretical exercise. Yet, this Court is mindful of the appropriate scope of its authority—it must take the law as it finds it.” 12/

Congress has created the law the way Judge O’Malley finds it—a “picture of injustice.” While we agree with Judge Gottschal that “no two cases are identical and reported cases may not describe all [the] salient facts,” the cases cited by Judge Gottschal and those which influenced Judge O’Malley’s “picture of injustice” conclusion clearly demonstrate there are serious problems in the federal sentencing process, especially in child pornography cases. It is fundamentally unjust to punish criminal defendants differently for committing essentially the same offense. Unexplainable and significant sentencing disparities are repugnant to our notions of justice.

We strongly suggest that Congress quit pandering to the “law and order” agenda and enact legislation that will bring about a more uniform federal sentence process which was in the original intent of the SRA.

SOURCES:

1/ “The History of Child Pornography Guidelines,” The United States Sentencing Commission, (October 2009). Not this year or even the year before and probably not next year either. A very sad commentary on the state of the state of America.

As the new year approaches, I see it as a new beginning. An opportunity for Americans everywhere to stand up, speak out and take back control of "our" country. The message to our politicians, our administration and to our controlling "too big to fail" should be and is - we have had enough. We are the people of this nation. We are your bosses. You all work for us. We want justice and we want our freedom back. We want jobs and we want homes. We want food to feed ourselves and our children. We want our American way of life back. Not with the excesses that were allowed us by our government and financial institutions in recent years but the way of life we enjoyed prior. Sure, it did not work for all, even then, but that should have been our mission - to help those less fortunate then the majority. Instead, we walked many millions of people into a candy store and said, "you can have all you want...just take it". We were constantly reminded of this by television commercials from JPMorgan/Chase in their "I want it all and I want it now" campaigns.

Instead of helping those "less fortunate" we increased the numbers of "less fortunate" and increased the incomes and lifestyles of those already on the top tier of income and lifestyle.

So as this holiday and New Year season is fast approaching, let us all resolve to take action and let our rulers know just how we feel. You see, we still have one thing going for us here in America - we can still vote someone out of office. We can let them know our intentions. We're going to fire them and allow them their pensions and health benefits. A gift far larger then any they have given us in quite some time.

With a resolution of taking action and correcting the many wrongs that exist, perhaps, resolution by itself, can help us take the time out during this holiday season to enjoy our family and friends without the stress that exists.

To your success and NEVER GIVE UP

Robert Paisola
http://www.RobertPaisola.com
CEO
The Robert Paisola FoundationRobert Paisolahttp://www.blogger.com/profile/00435871035547197331noreply@blogger.com0tag:blogger.com,1999:blog-1912588256876634544.post-16365780317487498692009-12-15T08:58:00.000-08:002009-12-15T09:00:57.949-08:006 people, including 4 police officers, indicted in fatal beating of Latino man in Pennsylvania, Justice Department says.<img style="display:block; margin:0px auto 10px; text-align:center;cursor:pointer; cursor:hand;width: 310px; height: 77px;" src="https://blogger.googleusercontent.com/img/b/R29vZ2xl/AVvXsEjKiaY1mdBIqonvdNzHMYXd8l48EXzQoBhoO1vnQAN9y3PRerHVGBQo3K56NKi7cdFieEuhSt2iCvO_OP2yOOuuDQKTECr0-ApbM19xiMpseM4f4SjM7c6_pv166_sqeeo6NfRA_6ozewKf/s400/logo.gif" border="0" alt=""id="BLOGGER_PHOTO_ID_5415508752046394898" />
Stay tuned to Prison Partners for further details on this emerging story

Robert Paisola
CEO
Western Capital MultimediaRobert Paisolahttp://www.blogger.com/profile/00435871035547197331noreply@blogger.com0tag:blogger.com,1999:blog-1912588256876634544.post-5892655268242979072009-11-16T17:32:00.000-08:002009-11-16T17:38:47.860-08:00The Harry Blausey Newark Ohio Case Continues.. This is why I created the
Robert Paisola Innocence Project, that has ...been endorsed by renounced attorneys Barry Scheck and Peter Neufeld.

The State of Ohio is going to be liable for MILLIONS of dollars for
their conduct in this matter, and no Public Official will be exempt
from prosecution, elected or appointed. In America, you do not have the
right to strip a man of his constitutional rights and simply send him
to jail because he is victimized by those that are paid to serve the
citizens. We thank the foundation and the Governor of the State of Ohio
as well as Warden Edward Banks as we navigate this serious matter. We
will never go away. We can not be paid off. We truly understand the pain and suffering that you are going through because of your personal situation. We do all that we can to make sure that every single piece of mail, email and request for information is responded to by one of our dedicated volunteers and staff members.

We also know that many of you believe that there are DNA specific issues that you wish to have reviewed, because you feel that the technology that is now available might be able to clear your loved one or client.

Because of this question, we feel that it is essential to respond openly to a very nice letter that we received from Scott M. Kareff, an Attorney based in New York City about our foundation. Wow! we are making a difference in the world! Thank You, Thank You, Thank You!

We openly commend Barry Scheck and Peter Neufeld who created the INNOCENCE PROJECT almost 15 years ago, out of a need for detailed analysis of cases of individuals who could and should be cleared because of technology that is now available that was not readily available 15 years ago.

This commitment by Barry Scheck and Peter Neufeld created a tidal wave of support, stemming from a small legal clinic affiliated with the Benjamin N. Cardoza School of Law at Yeshiva University, that was dedicated to exonerating wrongfully convicted individuals THROUGH DNA TESTING and reforming of the criminal justice system to prevent further injustice.

For over 15 years Barry Scheck and Peter Neufeld have been able to raise public awareness of the serious problems in the Criminal Justice System. The continue, through The Innocence Project, to educate the public via classes, seminars, conferences, clinics, and workshops in the field of Criminal Justice.

Their success is amazing and they even decided to create an "Innocence Network" that includes The Alaska Innocence Project, The Arizona Justice Project, The Northern Arizona Justice Project, The Innocence Project Arkansas, the Midwestern Innocence Project, The California and Hawaii Innocence Project, The Northern California Innocence Project at Santa Clara University, The Colorado Innocence Project, The Connecticut Innocence Project, The New England Innocence Project, The Mid Atlantic Innocence Project, The Innocence Project of Florida, The Georgia Innocence Project, The Idaho Innocence Project, The Medill Innocence Project, The Downstate Illinois Innocence Project, The Innocence Project of Iowa, The Wisconsin Innocence Project, The University of Kentucky Innocence Project, The Innocence Project of New Orleans, The Innocence Project of the Northwest, The Thomas M. Cooley Innocence Project, The Michigan Innocence Clinic, The Innocence Project of Minnesota, the Mississippi Innocence Project, the The Innocence Project at UVA School of Law, The Montana Innocence Project, The Nebraska Innocence Project,The Rocky Mountain Innocence Center, The New England Innocence Project, The New Mexico Innocence and Justice Project, The OHIO Innocence Project, The Pennsylvania Innocence Project, The Palmetto Innocence Project, The Texas Innocence Network, The Innocence Project of Texas, and The Wesleyan Innocence Project. (Special thanks to Attorney Scott M. Kareff for this resource listing)

As a result of the work that started with two men and a dream, Barry Scheck and Peter Neufeld created a very well respected Network of Individuals who share in the same goal, to free the innocent. Through their worldwide website at www.innocenceproject.org , Scheck and Neufeld have gained the respect of the world, as they have taken the DNA Evidence Provision to a new standard.

Our question is simple? Where are the other States NOT LISTED ABOVE in their pursuit of Freeing the Innocent Man through usage of technology? Simply said... They are nowhere to be seen!

Attorney Karreff stated that "Having looked into your (The Robert Paisola Foundation) organization, it's mission and its achievements, The Innocence Project is aware and applauds you for your successes that you have had" We thank Barry Scheck and Peter Neufeld, Mr. Kareff and their organization for their notice of the success that we are having around the world! There is no better endorsement than that of Attorney Karreff on behalf of the FOUNDERS of the Innocence Project, and The Innocence Project itself.. his clients!

One thing that Attorney Karreff pointed out in his letter to our office was that even though our successes are and have been noticed on a worldwide basis, there are still people who may believe that we can assist or have the ability and funding to deal with DNA Specific Issues.

This truly makes sense, as the world is aware of the power of DNA Testing, and the decisive changes that it can make to a family of the falsely accused and its global scientific value.

We want to be completely clear to our readers that we do not deal with DNA issues and do not have the ability to assist those seeking exoneration via DNA Extraction and Comparison Methodologies. This is where we simply ask you to visit the Innocence Project Website and "get in line" as you seek the assistance you deserve. If you need assistance not in the scientific realm, but of an investigative nature, we can assist you.

What we do at the Robert Paisola Foundation is much different than what Barry Scheck and Peter Neufeld do with their Network of Affiliate Agencies listed above. We use the media and our investigative techniques and technology to not only prove a mans innocence, but through usage of Investigative Media Techniques and endorsements from world renowned experts across the globe we create public awareness using our vast networks to ensure that EVERYBODY INVOLVED, including the Court, The Judges, The Prosecutors, The Inmates, The Families, Defense Counsel, The Prosecution and most importantly, our readers, viewers and listeners simply know and understand that there is a problem that must be resolved. We do not churn the courts with paperwork, we do not grandstand, we simply point out the issues that have created the illegal conduct that Imprisoned the Condemned , regardless of the "political correctness" of our methods.

The bottom line is if you choose to screw with one of our clients, and you make a mistake, your statements will be heard worldwide. We promise you that.

The Innocence Project that was started by Scheck and Neufeld is applauded by The Robert Paisola Foundation for their work to free the innocent. We are similar, however there are many differences. And you will see in the future, as we forensically examine the Harry Blausey Case based in Licking County (Newark, Ohio) that we are spending a very large sum of money to do what the trial counsel failed to do, and to present that to the people that count, The American Public and Judge Thomas Marcelain of Newark, Ohio, Licking County Ohio via www.HarryBlausey.com.

You should also know that Scheck and Neufeld have a very sophisticated method for accepting cases and that because of the OJ Simpson Trial, they have gained the right to pick and choose who they represent. We understand that they have even created a way to authorize, license and sponsor agencies that support their ideals. And money is generated from the creation and fees generated at their classes, seminars, conferences, clinics, and workshops in the field of Criminal Justice. They have even trademarked their Name INNOCENCE PROJECT ! Impressive!

So, even though we know that the intentions of their organization are somewhat parallel to our missions and goals, we need to again state, we can not assist with issues involving the "Innocence Network" including Murder Issues and Sexual Assault Issues, as we leave that to the worlds best.. Scheck and Neufeld.

Therefore, we want to make a public statement that if you need assistance in the areas covered by The Innocence Network, contact one of their affiliates listed above or below. If you are in a state that does not have an official innocence project, including Utah, we ask one simple question... WHY?

Scheck and Neufeld, publically state that in addition to working on behalf of those who may have been wrongfully convicted of crimes throughout the United States, The Innocence Project performs research and advocacy related to the causes of wrongful convictions. The Innocence Project is a member of the Innocence Network, which brings together a number of innocence organizations from across the United States.

As of July 23, 2009, 240 defendants previously convicted of serious crimes in the United States had been exonerated by DNA testing. Almost all of these convictions involved some form of sexual assault and approximately 25% involved murder. (See Wikipedia)

As of July 23, 2009, 240 defendants previously convicted of serious crimes (Murder Issues and Sexual Assault Issues) in the United States had been exonerated by DNA testing. Almost all of these convictions involved some form of sexual assault and approximately 25% involved murder.(See Wikipedia)

The Robert Paisola Foundation pays high regard to these men who have dedicated their lives to the pursuit of justice and commends their organization for their dedicated focus on Sexual Assault and Murder. This is now essential to our society.

We thank Barry Scheck and Peter Neufeld, Attorney Scott M. Kareff and the entire Innocence Project Team for their acknowledgment of our accomplishments. This means more than you know.

We are in the process of garnering support throughout the country so that The Robert Paisola Foundation, just like The Thomas M. Cooley Innocence Project that are now part of the Innocence Network, will be added to the list of agencies, foundations and individuals who are focused on the goal of freeing the innocent, using a web of agencies in the United States, Canada, the United Kingdom, Australia and New Zealand to create a non-competitive environment for all who endure to free the enslaved.

In this battle for justice, there are no competitors, just alliances. And the alliances run deep.

We ask Attorney Kareff in this open forum to now allow the hundreds of organizations who work on a daily basis to work side by side with your official clients of the Innocence Project, as they progress toward their mutual goals of reuniting those in The Criminal Justice System with their loved ones. Can you imagine what the world would be like if you were able to continue your trend of freeing 240 innocent people WITH the assistance of hundreds of organizations that share the same ideals as your clients Scheck and Neufeld? We believe that based on statistical data almost 20 percent of the imprisoned population is truly innocent... guess how many are of African American Descent? You know the numbers.

In the meantime, we honor our different approaches to freeing the accused, and pay tribute to the scientific methods of dealing crimes such as Sexual Assault and Murder, but ask you to now open the doors of freedom to men like Harry Blausey, Rick Koerber, Steve Cloward,Robert Lambert and Many others, who represent a new generation of perceived "White Collar Defendants" who are unjustly incarcerated for many years because of illegal and unethical issues with Counsel, Side Deals with the Prosecution, "Counsel who SOLD OUT for other Clients", The Media, The Public Paid Investigators, The Paid vs Non Paid Lawyers and The American Public, who were all convicted in the media... many months if not years before their "day in court"

Thank you Attorney Scott M. Kareff and your firm for your support. We are here 24/7 if you need us!

To your continued success,

Robert Paisola
President
The Robert Paisola Foundation , The Prison Partners Network and BOPWatchdog.com
www.RobertPaisola.com
vindication@robertpaisola.org
The Robert Paisola Foundation (Does not deal with DNA Innocence Project Issues)
63 East 11400 South
Suite 407
Sandy, Utah 84070

Note:
If you are charged with a sexual assault or a murder, please visit the website of Barry Scheck and Peter Neufeld. Children suffer most in these conditions being that they are helpless and vulnerable.

With the severe economic shocks that rocked the Nigerian economy during the early 1980s there has been a steady increase in the level of poverty in the country. Among the factors contributing to the shocks were declining prices of oil, the country's main export, and rises in real international interest rates that compounded the external debt. The major underlying reason, however, was domestic policy mistakes.

Economic reforms were introduced by the government of Nigeria in mid 1986 in a structural adjustment program that included exchange rate devaluation, trade and financial reforms, and budgetary and monetary contraction. These reforms have not revitalized the economy's growth in Nigeria. Rather, there has continued to be the widening gap between the poor and the rich.

Having experienced first-hand this deplorably poor lifestyle, Ikoro and Ndudi started Mission Africa in 2003, a non-profit organization with a 501(c)3 status, with a mission to open creative doors of cultural exchange to positively impact the people of Africa.

Mission Africa board is made up of compassionate men and women with a desire and enthusiasm to create strategic alliances and obtain resources to assist the underprivileged in Africa especially, the children.

This Organization is an idea whose time has come. It signifies our contribution towards making life bearable for poor innocent children in Africa through the giving of kind hearted individuals, businesses and charitable organizations

GOALS AND OBJECTIVES

The goals and objectives of this project shall be divided into three namely: short term, medium and long term.

Short Term

In pursuit of these objectives, Mission Africa in partnership with LIWOCARE, has been engaged in the following activities: free medical outreaches, care for widows, Offer scholarships and school supplies to the poor and needy children, contribution to orphanages, feeding of street beggars, skill acquisition\rehabilitation programs, payment of hospital bills for indigent people, support of the deaf, dumb and blind, counseling and much more.

Twice a year, Mission Africa offers opportunities to Americans who desire to experience life in a different culture, through short-term mission trips, to Africa. This provide an avenue for many to see first-hand, the desperate situations of these helpless children in Africa.

Medium Term

Medium term objectives will focus on the expansion of the above objectives and outreach programs to become a mission field for economic development, and cultural exchanges between people's of the world. Mission Africa has a mandate to

v To provide, care, nurture and rehabilitate all those who are in physical, material, mental and spiritual needs; the poor, the depraved, the abandoned, prisoners, the oppressed, the distressed, the homeless and the dejected.

v To protect and defend the rights of children, the helpless, the oppressed,

v To build and establish, orphanages

v To build a global Mission house for missionaries and a retreat ground for church leaders

v To build and establish health clinics for the poor and helpless.

v To build a Youth (Vocational) Centre to train the youth on trade skills

v To provide gainful employment for the unemployed.

v To establish small businesses for responsible adults through micro loans

v To create tangible awareness about HIV/AIDS among the youth

v To reduce infant mortality by providing nutrition and health care services

v To work with adoption agencies in America for possible adoptions from our

v To offer educational opportunities through scholarship

v To provide means of transportation to missionaries by acquiring Mission Vans/SUVs

v To provide counseling services, organize workshops and seminars aimed at uplifting the condition and environment of the poor and needy in the society.

v To liaise with prison authorities, legal departments, hospitals, remand homes and orphanage with a view to assisting the inmates.

These efforts will exhibit the wealth of untapped gifts, talents and creativity imbedded in these neglected African children. Mission Africa will provide wholesome family economic sustainability within the framework of individual cultures and lifestyles of various African peoples. Teaching them to fish and not provide the fish all the time.

Long Term

Long term is to engage in educational and cultural exchanges between participants in the US and the various peoples of African countries. This is more so now that there is a major growth in private universities, civil society initiatives and international businesses. We may subject to availability of resources, produce arts, craft and cross-cultural educational materials for use both in Africa and the US.

MISSION AFRICA OVERVIEW

Description of Projects

Mission Africa started by partnering with organizations that are actually doing the work, running orphanages, providing for the poor and needy etc.

Clearly stating the vision of Mission Africa, will provide the compassionate with step-by-step directions on how to gather those in their sphere of influence and, together, do something life-saving and life-changing! for underprivileged families in Africa.

100% of all donations for Mission Africa projects go entirely to the designated project. Mission Africa solicits funds from businessmen and individual sponsors to specifically fund the administrative costs, staff and overhead. These projects include:

v To build, 3 orphanages each housing 30 orphans (1st building in progress)

v To build 1 Youth (Vocational) Centre to train the youth on trade skills

v To build 2 Health Centres (1st Building in progress)

v To build 2 Mission Houses to house and care for mission teams and church leaders.

v To provide Mission Vans/SUVs for Missionaries' transportation while in Africa.

Methodology

Mission Africa intends to use our experiential knowledge of the culture, traditions and mannerisms of Africans to determine and prioritize the needs, one village or city at a time. Our board and donors will be guided by appreciative inquiry, supplemented by action research and indigenous empowerment to solicit and receive funds and resources needed for these projects.

Partners of Mission Africa LIWOCARE and Caring Hearts International stationed in Africa will supervise projects and make sure the work is done. They will report to the board of Mission Africa on a constant basis.

Mission Africa teams will go to Africa twice yearly to monitor and evaluate the progress of individual projects

Justification

The main justification for this project is as they say that the world has become a global village. In the Seattle area of Washington State, the Igbos of South-eastern Nigeria constitutes a sizeable proportion of the population. There are also a sizeable number of other ethnic groups from Nigeria. There are also immigrants from other parts of Africa. All these migrations is in a bid to find better life and help for those left behind in Africa.

Mission Africa has a mandate to find ways to improve and sustain the standard of lives in Africa and restore a sense of dignity and pride to people who have no means of escaping the hard life among the poor there. This will entail the support of all local and international philanthropic individuals and organizations. To achieve our objectives, there has to be synergy between all peoples working on the projects.

Through these projects, Mission Africa will provide a forum for people to exchange and learn some of the cultures, values and behavioural patterns of those they may be working with in future. It will also be a forum for people to exchange and learn about such values as tolerance, respect and recognition of differences.

_____________________________________________________________________

Youth Vocational Centre

Open to all youth ages 12 21 years who desire to learn a vocation or a trade.

Will offer training and apprenticeship programs on the following trades:

Carpentry, Plumbing, Dress making, Hair braiding, Hair dressing, Electricians, Fashion designing, Barbing, Shoe making, computer skills and much more.

The Centre will also house lots of recreational games for the youth such as: Table tennis equipment, Pool table, Basket ball court, Volley ball court, Cyber Café etc. These will all generate funds.

The 2nd floor will house a big hall for rent by the public for weddings and other occasions to generate funds for sustainability.

____________________________________________________________________________

Global Mission House

Two buildings of 8 (3 bedrooms, 3 baths) apartment complexes to house Missionaries that visit that part of Nigeria year round.

Global Mission House will also serve as a retreat centre for Pastors, and church leaders at a minimal cost. These kind of facilities are lacking in the eastern part of Nigeria.

Mission Africa teams will use the mission house whenever they visit Nigeria. It will save lots of money on hotel bills. Modern amenities will be included for certain level of relaxation and comfort. It will be exclusive for Christians and will also generate funds.

____________________________________________________________________________

2 Health/Women Clinics - # 1 (Building already in progress)

v This project is designed to alleviate the health care crisis in Africa, one clinic at a time.

v Addressing the HIV/AIDS crisis through a health care and educational framework.

v Assisting women's reproductive health issues.

v Providing quality health care on a sliding-fee scale.

v Distributing affordable and unadulterated medicine.

____________________________________________________________________________

FINANCIAL SUPPORT

The Mission Africa budget amount would come from individuals, business and charitable organizations making donations to support Mission Africa projects

SELF-SUSTAINABILITY

The Youth Centre and Global Mission House will bring in funds to sustain themselves. Graduates from the Youth Centres would be supported through micro loans which will be paid back with minimal interest. That too will be a means of generating funds. The orphanage would also bring in funds through local and international adoptions fees.

OUR FUTURE

The future for Mission Africa is to engage in educational and cultural exchanges between participants in the US and the various peoples of African countries. This is more so now that there is a major growth in private universities and civil society initiatives. We may subject to availability of resources, produce cross-cultural educational materials for use both in Africa and the US.

Mission Africa mandate is an vision whose time has come. If we have to build an inclusive world where basic needs are met for children and desperate families globally, then, you have to support Mission Africa. This project will signify your contribution towards alleviating poverty world wide. Our mandate has become imperative because the world seems set on a part of prejudice, hate, intolerance and self-centeredness. That is not the way for a world that should be home to all. We look forward to your support for Mission Africa; you will be saving lives, one child at a time, one family at a time, one village at a time.Robert Paisolahttp://www.blogger.com/profile/00435871035547197331noreply@blogger.com0tag:blogger.com,1999:blog-1912588256876634544.post-32521682837731917112008-02-25T05:33:00.000-08:002008-02-25T05:39:39.818-08:00WORDS CAN NOT DESCRIBE....
